End User License Agreement (EULA)

Scope: This End User License Agreement ("Agreement") applies to the Fincend, Spending, and NoSpend mobile applications, all developed by Fincend. By downloading, installing, or using any of these applications, you agree to be bound by all terms of this Agreement.

This document is the binding legal version. Translations may be provided for convenience only and do not alter the terms herein.

1. License Grant

1.1. License Right

Fincend grants you a non-transferable, non-exclusive, limited license to use the Fincend, Spending, and NoSpend applications for personal, non-commercial purposes, subject to the terms of this Agreement.

The applications and all content, features, and functionality contained therein (including but not limited to software, text, images, logos, icons, and their design) are the exclusive property of Fincend or its licensors and are protected by Turkish and international copyright, trademark, patent, trade secret, and other intellectual property laws.

5. Subscription and Payments

Fincend offers basic features free of charge. A subscription is required to access premium features. Subscription fees and terms are clearly stated within each application.

Refund requests are subject to Apple's or Google's policies. Fincend does not process refunds directly.

6. Disclaimers and Warranties

6.1. Service Provided "AS IS"

The applications are provided "as is" and "as available". Fincend makes no warranty that the applications will operate uninterrupted, timely, secure, or error-free.

6.2. Not Financial Advice

IMPORTANT: The Fincend, Spending, and NoSpend applications do not provide professional financial, investment, or tax advice. All recommendations are for informational purposes only. It is recommended that you consult a qualified financial advisor before making important financial decisions.

6.3. Data Accuracy

We do not guarantee the accuracy of calculations, analyses, and reports provided by the applications. Users are advised to verify their own financial data.

7. Limitation of Liability

To the maximum extent permitted by law, Fincend or its licensors shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the applications, including but not limited to:

8. Termination

You may terminate this Agreement at any time by deleting the applications from your device and closing your account.

10. Updates and Changes

10.1. Application Updates

Fincend reserves the right to update the applications regularly. Updates may:

We reserve the right to update this Agreement from time to time. When significant changes occur, we will notify you via in-app notification or email. Your continued use of the applications after updates means you accept the changes.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the Courts and Enforcement Offices of Istanbul.

12. Relationship with Apple

This Agreement is between you and Fincend, not with Apple, Inc. Fincend, not Apple, is solely responsible for the applications and their content. Apple has no obligation to provide any maintenance or support services for the applications.

If you downloaded any of the applications through the Google Play Store, you are also subject to the Google Play Terms of Service. In the event of a conflict between this Agreement and the Google Play Terms of Service, the Google Play Terms of Service shall prevail.

If any provision of this Agreement is held to be unlawful, invalid, or unenforceable, such provision shall be severable from the Agreement and the remaining provisions shall remain in full force and effect.

15. Waiver

Fincend's failure to enforce any provision of this Agreement shall not be construed as a waiver of such provision. Any waiver shall not be valid unless made in writing.

16. Entire Agreement

This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and us regarding the use of the applications and supersedes all prior written or oral agreements relating to the subject matter.

By downloading, installing, or using any of the Fincend, Spending, or NoSpend applications, you acknowledge that you have read and understood this End User License Agreement and agree to be bound by its terms. If you do not agree to these terms, you should not download, install, or use the applications.
